New York Divorce Law
New York has a fault based divorce system, meaning one spouse must prove in a court of law that the other is at fault in one of four ways: by cruel and inhuman treatment, abandonment for one or more years, imprisonment for three or more years or adultery.
Another way to divorce involves living apart for one year under a separation agreement signed by the parties, or following separation judgment granted by the court. This then becomes a "no-fault" divorce, in which neither spouse is judged to be at fault, provided that the spouse seeking the divorce has substantially complied with the provisions of the judgment or agreement.
